Welcome to The Artisan Market Store (referred to as “we,” “us,” “our,” or “the Store”). These Terms and Conditions (“Terms”) govern your access to and use of our website, located at https://theartisanmarket.store (the “Site”), and any purchases made through our online store.

Please read these Terms carefully before accessing or using our Site. By accessing, browsing, registering an account, or purchasing from our Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, you may not access the Site or use any of our services.

The Site is operated by The Artisan Market Store, but you are purchasing products directly from our independent Artisans.

3. Eligibility & Account Registration

By using this Site, you represent that you are at least 18 years old or have the consent of a parent or legal guardian to make purchases.

To access certain features of the Site, including tracking orders, viewing purchase history, or managing custom artisan requests, you may register an account through our “My Account” page.

  • Accuracy of Information: You agree to provide accurate, current, and complete information during the registration process.
  • Account Security: You are responsible for safeguarding your account credentials (username and password) and accept all risks of unauthorized access.
  • Unauthorized Use: You must notify us immediately of any unauthorized use or breach of security regarding your account.
  • Account Suspension: We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity.

4. Product Descriptions, Pricing, and Availability

The Artisan Market Store is a platform displaying curated, unique, and handcrafted products created by artisans globally.

  • Handcrafted Nature: Because many of our products are individually handmade, slight variations in color, size, texture, and design are natural, to be expected, and form part of the unique character of the items.
  • Product Representations: We make every effort to display product colors and details as accurately as possible. However, we cannot guarantee that your monitor’s display will perfectly reflect the actual color of the physical item.
  • Pricing: All prices displayed on our Site are in Euros (€) unless otherwise indicated. We reserve the right to adjust prices at any time without prior notice.
  • Taxes & VAT: Prices are inclusive of local value-added taxes (VAT) where applicable, based on the customer’s geolocated billing address.
  • Availability: Products are subject to availability. If a product becomes unavailable after an order is placed, we will notify you promptly and offer a full refund or an alternative item.

5. Orders and Payments

  • Order Acceptance: Once you place an order, you will receive an automated order confirmation email. This email does not constitute acceptance of your order; it confirms that we have received it. A contract between you and the Vendor is only formed when your order is processed and dispatched.
  • Payment Methods: We accept payment methods configured via our secure checkout gateway (e.g., credit cards, debit cards, or alternative payment providers like Stripe or PayPal).
  • Payment Authorization: By submitting payment information, you authorize us (and our third-party payment processors) to charge the full transaction amount to your chosen payment method.
  • Order Rejection: We reserve the right to refuse, cancel, or limit any order for reasons including, but not limited to, suspected fraud, pricing errors, or shipping restrictions to your location.

6. Shipping, Delivery, and Custom Duties

  • Shipping Locations: We offer shipping globally, utilizing reliable courier services through our integrated logistics partnerships.
  • Delivery Times: Shipping times displayed at checkout are estimates. We are not liable for shipping delays caused by custom clearance processes, courier delays, force majeure, or incorrect address details provided by the buyer.
  • Import Duties & Customs: If you order products for delivery outside of the European Union (EU), you may be subject to import duties, customs fees, and local taxes, which are levied once the package reaches your country. All customs clearance fees and import duties are the sole responsibility of the customer.

7. Returns, Refunds, and Right of Withdrawal (EU Consumers)

As an online store operating under the laws of Malta and the European Union, we honor the statutory consumer rights of our EU clients. All purchases are also subject to our Global Shop Policies.

  • The Statutory 14-Day Right of Withdrawal: If you are an EU resident, you have the right to withdraw from your purchase contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day you (or a third party designated by you) physically receive the goods.
  • Notification of Withdrawal: To exercise this right, you must inform the vendor of your decision to return the item within this 14-day period. The easiest way to do this is through the “Contact Vendor” feature in your order history.
  • Exceptions to the Right of Withdrawal: Under EU law, you cannot return or cancel purchases for custom-made or personalized products (items specifically handmade or modified to your specifications), perishable goods, or sealed items unsealed after delivery for health or hygiene reasons (such as earrings or cosmetics).
  • Return Shipping & Refunds: Unless otherwise agreed, you must bear the direct cost of returning the goods. Returned goods must be sent back unused, in their original packaging, and in merchantable condition. Upon inspection, the refund will be processed within 14 days to your original payment method.

8. User-Generated Content and Reviews

If you post reviews, comments, photos, or other content on our Site:

  • License Grant: You grant us a non-exclusive, royalty-free, perpetual, and irrevocable right to use, reproduce, modify, publish, and display such content worldwide in any media.
  • Representations: You represent that you own or control all rights to the content you post, that the content is accurate, and that it does not violate these Terms or infringe upon any third-party rights.
  • Content Monitoring: We reserve the right (but not the obligation) to monitor, edit, or remove any user-generated content that we deem offensive, inappropriate, or misleading.

  • Site Content: All content on this Site, including text, logos, graphics, icons, digital images, software, and code, is the property of The Artisan Market Store, its parent company IThub4u, or its collaborative artisans, and is protected by Maltese and international copyright, trademark, and intellectual property laws.
  • Exploitation Restriction: You may not extract, copy, duplicate, sell, or exploit any portion of the Site or its content for commercial purposes without our express written consent.

10. Privacy & Data Protection

Your privacy is highly important to us. Our data retention and storage policies are designed to comply with the European General Data Protection Regulation (GDPR) and local Maltese laws.

  • Data Alignment: Personal data related to accounts, orders, cancellations, and sales is retained in accordance with our system configuration settings as described in our Privacy Policy. For example, inactive accounts are deleted after 24 months, while tax-related completed order history is retained for 72 months (6 years).

11. Limitation of Liability

To the maximum extent permitted by applicable Maltese law:

  • No Indirect Damages: The Artisan Market Store and IThub4u are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site, purchases made, or delayed deliveries.
  • Liability Cap: Our total liability to you for any claim arising from a purchase made on our Site is strictly limited to the purchase price of the product in question.

These Terms, and any disputes arising from your use of the Site or purchases made, shall be governed by and construed in accordance with the laws of Malta.

  • Amicable Settlement: If you have a complaint, please contact us directly first so we can work together to find an amicable solution. Any legal proceedings that cannot be resolved out of court shall fall under the exclusive jurisdiction of the Courts of Malta.
